Administration of Estates
We administer a broad range of estates for both Irish clients and overseas clients with Irish assets.
As our experienced lawyers are qualified to advise on Irish tax, we can advise on all aspects of the estate administration, including regularising the lifetime tax affairs of the deceased with the Irish Revenue Commissioners(if required), taxation of estate income, taxation of estate disposals, taxation arising for beneficiaries and on the application of double taxation agreements.
We have particular expertise in dealing with complex international estates with assets and beneficiaries in numerous jurisdictions. We regularly work with foreign advisors to obtain foreign grants of representation to obtain title to assets and ultimately, realise them or collect them in for distribution to beneficiaries.
We have unrivalled experience in administering estates with a diverse profile of assets, including assets of significant value, assets with significant family connection, assets with unusual title (such as royalty rights), assets in the custody of the State (such as artwork on display), trading companies, offshore companies and digital assets.
We also regularly act for financial institutions to appoint an administrator ad litem to an estate for the purposes of issuing litigation.
We are experienced in advising on complex high value estates that become insolvent during the course of the administration, including advising executors and negotiating with significant creditors, advising and representing estates in mediation with creditors, negotiating and drafting complex settlement agreements and advising on their implementation.
We advise on the application of domestic Irish succession law and Irish Private International law on Succession, including cases where the deceased had a complex domicile profile. We advise on the application of the EU Succession Regulation to Irish estates.
The Private Client department is able to draw on its full range of expertise to deal with such cases which often involve complex tax, family and succession law issues.
